PEN, planned early negotiation, is a concept and technique for lawyers developed by Professor John Lande with the support of the American Bar Association. In a nutshell, the idea is that if lawyers know that more than 90% of their cases will never go to trial, shouldn’t they plan their negotiation/settlement strategy from the beginning?
The second edition of Lande’s book on PEN, suggesting how to do just that, was published in April 2015 by the ABA.
He also presented excellent materials in programs, sponsored by the Joint ADR Committee, during the January 2015 Annual Meeting of The Virginia Bar Association. The presentations "Lawyering with Planned Early Negotiation: How to Get Good Results for Clients and Succeed" and "Framing Your Case for Mediation" are available for viewing or listening through the VBA Online CLE store.

How to Join
There are two ways to join the Joint ADR Committee. Which you use depends on whether you are a VBA member or a VBA nonmember. Both require Joint ADR Committee members to have a profile on the VBA website. Annual dues are $25.
VBA members can simply add enrollment in the Joint ADR Committee to their membership.
