About
The purpose
of the ADR Joint Committee is to bring together members of the Virginia
Bar Association (VBA) and the Virginia State Bar (VSB) who have a
special interest in alternative dispute resolution. The Committee's
activities include addressing issues of professional ethics and
standards of practice; educating lawyers and ADR professionals on
current developments and opportunities in the field through CLE
programs, the Virginia ADR newsletter, and the website; keeping abreast
of legislation and public policy; and developing creative uses of ADR
processes and strategies to provide better service to clients. It is
active in all areas of alternative dispute resolution, including
mediation, arbitration, facilitation, neutral case evaluation,
negotiation, conciliation, settlement conferences, restorative justice
and collaborative law.

adoption of the Revised Uniform Arbitration Act would have on
arbitration law and practice in Virginia.

it Matter?” (2004). This article highlights the importance of
choice of law provisions in arbitration agreements, given the Fourth
Circuit’s holdings on what law applies to arbitrations.

which was originally presented at a Virginia Mediation Network
conference, outlines the law of confidentiality in mediation proceedings
in Virginia.

“Well-Tailored ADR: Getting Your Client The
Right Fit Is
a Matter of Ethics”
In order to assist Virginia lawyers to comply with
counseling requirements under the Virginia Rules of Professional Conduct
with regard to ADR, the Virginia Joint Committee on Alternative Dispute
Resolution embarked in 2009 upon an outreach effort. It sponsored an
Ethics CLE, under the above title, at both the January Annual Meeting of
The Virginia Bar Association and the June Annual Meeting of the Virginia
State Bar. There was strong favorable response to it, and The Joint
Committee realized that its outreach efforts had just begun.
We therefore followed the CLEs with a summary of
their content in a Guest Column published by the Virginia Lawyers
Weekly on August 3, 2009.
Now, as a public service to all Virginia lawyers,
we post on this website the article published by VLW (with the kind
permission granted by Virginia Lawyers Weekly) together with
selected hand out materials from the CLE ethics programs. We ask that
you consider this material, and share it with your own colleagues. We
welcome any feedback you have on our outreach efforts.
Finally, we thank The Virginia Bar Association for
the effort in posting this material, and Paul Fletcher of the VLW for assisting in this public service.
