What to Expect

Business entities large and small have been evaluating what services and procedures they can migrate into digital channels for some time, but those decisions have taken on new urgency in the age of social distancing under COVID-19. Many companies are exploring increasing online and mobile customer and partner interaction channels, moving execution of customer agreements to online and mobile channels, and exploring vendors and technology solutions to help achieve these goals.

This session will provide an overview of the U.S. law on electronic signatures and electronic contracting, and address steps to ensure compliance with E-SIGN and legal enforceability of electronic signatures. The presentation will also address unique considerations in certain types of electronic transactions, such as consumer and commercial loan transactions involving real estate and unique issues regarding remote online notarization and electronic recording challenges for these transactions.

Erin’s practice focuses largely on four areas: FinTech, traditional and emerging payments (including mobile), banking operations and regulatory, and privacy and data security.

Erin is co-chair of the firm’s financial institutions corporate and regulatory practice. She assists clients with a broad range of legal and regulatory matters related to payments and payment systems, digital commerce, banking and financial services, technology and internet products, privacy and data protection laws, and general corporate matters.

Erin regularly advises financial institutions and alternative payment providers regarding mobile banking, mobile payments, and mobile wallet products and services. She has been involved in the creation of new payment networks and has worked extensively on emerging products, services and network operating rules related to mobile payment systems.

On behalf of advertisers, marketers and retail companies, Erin provides industry-focused guidance regarding mobile payments and add-on mobile products such as mobile loyalty/rewards and geo-location advertising, coupons and offers. She also has experience with a broad range of matters related to e-commerce technology and internet products, confidentiality and data security laws. In addition, Erin counsels clients on a broad range of general corporate matters.

Cecilia has deep experience with complex commercial and innovative technology transactions, especially pertaining to e-commerce, payments and FinTech services.

She is known for negotiating a wide range of technology transactions, including those involving payment systems, information technology and business process outsourcing, cloud-based services, ERP implementations, e-commerce and general licensing. In particular, she focuses on technology agreements in the financial services and retail industries. Her work often involves providing practical advice to clients on core banking platforms, account processing solutions, merchant processing services, card tokenization services, encryption solutions, payment gateway services, PCI DSS compliance, E-SIGN compliance, and emerging payment solutions, such as mobile wallets. 

Cecilia’s clients include some of the largest financial institutions and retailers in the United States.
