VBA to Consider Candidates for EDVA Judgeship

A vacancy has opened on the U.S. District Court for the Eastern District of Virginia. Judge Rebecca Beach Smith took senior status, effective Aug. 1.

U.S. Sens. Mark R. Warner and Timothy M. Kaine are accepting applications from candidates interested in pursuing a nomination. The deadline to submit materials to them is Aug. 28.

Candidates must fill out a questionnaire available on Sen. Kaine's website, and submit the completed questionnaire, a cover letter, resume and any other requested materials to the senators at kaine_test@kaine.senate.gov.

The senators also have asked statewide and specialty bar associations in Virginia to evaluate candidates.

The VBA Committee on Federal Judgeships - Eastern District will evaluate prospects who also submit information to The Virginia Bar Association.

To be evaluated by the VBA committee, submit the following by 4:30 p.m. Aug. 28, 2019, to Executive Director R. Yvonne Cockram at ycockram@vba.org:

  • A letter requesting the VBA's recommendation
  • A copy of the completed Virginia State Bar questionnaire (Word document)
  • A résumé
  • One or more writing samples of judicial opinions, legal briefs or law review articles written by the candidate that the candidate believes will assist the committee evaluation
  • Any other written materials the candidate believes will assist the committee
  • Any other materials that the committee requests.

No in-person interviews will be scheduled by the VBA committee.

The senators anticipate proposing nominations this fall. U.S. district judges are appointed by the president of the United States. They undergo hearings before the Senate Judiciary Committee in advance of a full Senate vote on confirmation.
