The General Assembly on March 7 elected Virginia Beach Circuit Judge Steven C. Frucci to a seat on the Court of Appeals of Virginia.

Frucci will succeed retired Judge Robert J. Humphreys, with his term beginning March 16.

The Assembly also elected a second judge for the court, Fairfax Circuit Judge David Bernhard, whose term will begin on Jan. 1, 2025.

During judicial interviews March 1, Sen. Scott Surovell, Senate majority leader and chair of the Senate Courts of Justice Committee, announced that Judge Glen A. Huff had written a letter advising he would be retiring from the court on Dec. 31 of this year.

Surovell, D-Fairfax, noted at the hearing that the Assembly can fill any vacancy due to a retirement when it happens during the same calendar year.

Bernhard, a seven-year veteran of the Fairfax circuit bench, has been a prolific opinion writer on the circuit bench; Surovell said Bernhard probably has written “30-40 opinions a year.”

The Assembly on March 7 also held elections for judges for circuit, general district and juvenile and domestic relations courts. Those results are as follows:

Circuit Courts

  • The Hon. David J. Whitted, of Chesapeake, as a judge of the First Judicial Circuit for an eight-year term beginning July 1, 2024.
  • Scott J. Flax, of Virginia Beach, as a judge of the Second Judicial Circuit for an eight-year term beginning May 1, 2024.
  • The Hon. Salvatore R. Iaquinto, of Virginia Beach, as a judge of the Second Judicial Circuit for an eight-year term beginning April 1, 2024.
  • Lynwood W. Lewis Jr., of Accomack, as a judge of the Second Judicial Circuit for an eight-year term beginning April 1, 2024.
  • The Hon. Alfred W. Bates, III, of Suffolk, as a judge of the Fifth Judicial Circuit for an eight-year term beginning July 1, 2024.

  • The Hon. Joshua P. DeFord, of Williamsburg, as a judge of the Ninth Judicial Circuit for an eight-year term beginning July 1, 2024.
  • The Hon. Devika E. Davis, of Richmond, as a judge of the 13th Judicial Circuit for an eight-year term beginning July 1, 2024.
  • Rebecca J. Wade, of Alexandria, as a judge of the 18th Judicial Circuit for an eight-year term beginning March 16, 2024.
  • The Hon. Susan J. S. Stoney, of Fairfax, as a judge of the 19th Judicial Circuit for an eight-year term beginning Jan. 1, 2025.
  • The Hon. Brian H. Turpin, of Pittsylvania, as a judge of the 22nd Judicial Circuit for an eight-year term beginning May 1, 2024.
